Welcome to 365 Photography. By booking a session, paying a retainer, signing a contract, or using our website, you agree to these Terms & Conditions.
A session is not considered reserved until:
Bookings are accepted on a first-paid, first-served basis.
The Photographer reserves the right to decline any booking.
A non-refundable retainer of 50% is required to secure your session.
The retainer:
Because dates are held exclusively for you, retainers are non-refundable under all circumstances except if the Photographer cancels the session.
Remaining balances are due:

Failure to submit payment may result in cancellation.
Returned payments may incur additional fees.
Late payments may incur:
No photographs will be delivered until payment has been received in full.
If the client cancels:

Clients may request one complimentary reschedule with at least 72 hours notice.
Additional reschedules may incur administrative fees.
Rescheduling is subject to Photographer availability.
If illness, emergency, natural disaster, equipment failure, or unforeseen circumstances prevent the Photographer from performing services:
The Photographer may:
No additional damages shall be owed.
Outdoor sessions may be rescheduled due to:
Weather decisions are made solely by the Photographer.
Clients should arrive:
Late arrivals reduce shooting time.
Sessions ending because of client lateness will not be refunded.
The Photographer will make every reasonable effort to arrive on time.
Minor delays caused by:

Unused time cannot be credited or refunded.
Additional time requested may be billed at the Photographer's hourly rate.
Travel outside the Photographer's service area may incur:

Clients acknowledge they have reviewed the Photographer's portfolio.
Editing style is artistic and consistent with previous work.
Requests for a different editing style after delivery may incur additional charges.
RAW files are never delivered.
Unless otherwise specified:
The Photographer selects:
Unedited images will not be released.
Requests including:
may require additional fees.
All photographs remain the intellectual property of the Photographer under United States Copyright Law.
The Photographer retains full copyright ownership.
Clients receive a personal-use license.
Personal use includes:
Commercial use requires written licensing.
Businesses may not:
using photographs without purchasing a commercial license.
Unless otherwise agreed, the Photographer may use images for:
Clients requesting complete privacy must notify the Photographer before booking.
Additional privacy fees may apply.
Clients grant permission for photographs to be used for promotional purposes unless an executed privacy agreement has been signed.
A parent or legal guardian must be present during sessions involving minors.
The Photographer may stop a session if conditions become unsafe.
This includes:
Abusive, threatening, discriminatory, or inappropriate behavior toward the Photographer or staff will result in immediate termination of services without refund.
While professional equipment and backups are maintained, the Photographer shall not be liable for image loss caused by:
Liability shall not exceed amounts paid.
Neither party shall be liable for delays or failure to perform caused by:
The Photographer's total liability shall never exceed the total amount paid for the services.
The Photographer shall not be liable for:
Submitting a booking request does not guarantee availability.
Bookings become confirmed only after:
Gift certificates:
Clients are responsible for downloading and backing up delivered images.
Online galleries may expire after 30–90 days.
Archival retrieval after expiration may incur a restoration fee.
Clients may share delivered images but may not:
Credit to the Photographer is appreciated when possible.
Photography is a custom creative service.
Because artistic work cannot be returned, refunds are generally not provided once services have been rendered, except where required by law or expressly stated in writing.
These Terms & Conditions shall be governed by the laws of the State in which the Photographer's business is registered.
Any disputes shall be resolved in the appropriate courts of that jurisdiction.
By booking photography services through this website, paying a retainer, or participating in a session, the Client acknowledges that they have read, understood, and agree to these Terms & Conditions.
At 365 Photography, we strive to provide an exceptional experience for every client. Please review our refund policy before booking.
All booking retainers are non-refundable and are required to reserve your session date. Your retainer covers scheduling, planning, and the reservation of your time slot.
Photography services are custom and time-based. Once a session has taken place, all payments are non-refundable.
Due to the nature of digital products, all delivered images, downloads, prints, albums, and other custom products are non-refundable.
